Lntv Property: Overage
Many contracts for the sale of residential or commercial development land will include some provision for the payment of ‘overage’ but how can the seller secure his share of the extra development value? It is necessary for the seller’s solicitor to ensure that the payment will actually be made and the parties will need to take great care to ensure the documentation precisely reflects what has been agreed. This programme begins by considering the agreement and provision for the payment of overage. It then moves to examine how to protect and secure the payment before looking at some of the risk points and drafting problems that can be encountered, looking to recent caselaw for guidance. Lntv Dispute Resolution: Using Single Joint Experts
The programme looks at the changes introduced to the rules on experts by the 50th Amendments to the CPR. Some small, but important, changes have been made, many of which are geared to reducing further the level of time and costs expended on cases. The programme focuses particularly on the amendments to the rules on single joint experts, the advantages and disadvantages of using them as well as considering some recent authorities. Contributors include Nick Andrews (UK Head of Expert Witness Service, KPMG), Margaret Bowron QC (1 Crown Office Row), Catherine Fox (Solicitor, Beachcroft LLP) and District Judge Margaret Langley (Central London County Court).
