Head IV - Principles of Common Law

An oral exam that tests knowledge and understanding of the principles of Common Law and competence in the English language. It covers the English Legal System and the principal statutes and substantive law of Contract and Tort.

You will be questioned by a panel of assessors and your exam will be recorded in case it needs to be reviewed later.

The Test covers four different areas of the syllabus – one of which you are required to prepare in more detail (the ‘Advance Topic’).You will be notified of the Advance Topic before the Test.

Immediately before the start of the Test, you will be given a document containing a law report, an extract from a law report or some statutory provision relating to the Advance Topic. You are given 30 minutes to study the document and make notes on paper provided by the College. During this time, you may refer to any book, document or other written material you may have.

You will be asked questions on both the Advance Topic and the document during the Test. The questions are designed to show that you can study and assimilate an area of Common Law and deal with any problems in that area. Please note that the only documents you may take into the Test are the document on the Advance Topic and the notes you made during the the 30 minute study period.

The pass mark is 50%.

Test arrangements

The QLTT is a test of aptitude, rather than memory, so you are allowed to take relevant books, documents or written materials into the Test (apart from Head IV).

You will be examined on the law as it stands on the day you are tested, to make sure your knowledge is up-to-date. You will not be asked to draft letters, statements of cases or other documents in any of the Heads, although Heads I and II may require you to comment on, or extract information from, documents provided to you at the Test sitting (you will be given an additional 30 minutes at the start of the Test to read these documents). To pass the Test, you will need to demonstrate that your English is of a sufficient standard to practise as a solicitor in England and Wales.

Broad topic areas will be sent out approximately 10 days prior to the Test. A reading list for each Head and the Solicitors’ Code of Conduct are available from www.sra.org.uk. Please see ‘Related items’ below for the QLTT Test Specification and Regulations.

Special needs
If you require specific Test arrangements, please give full details when you make your booking, together with supporting medical evidence or other details. We will contact you to discuss facilities that can be arranged for you.
