Trainee Litigation Programme
course overview

What?

Our two-week Trainee Litigation Programme is designed to give trainee solicitors experience equivalent to that gained during a contentious seat, offering an ideal alternative for trainees who may not intend to practise in this area. The programme blends face-to-face tuition with hands-on experience in our Legal Advice Centre, and can be completed between seats or while another seat is in progress. Training is available on an in-house basis for organisations with a number of suitable trainees. There is also a public programme of dates available to individual trainees.

Who?

The programme is aimed at trainee solicitors who may not intend to practise in litigation – as an alternative to undertaking a contentious seat as part of their training contract but this does not preclude a trainee from changing their mind at a later stage.

Why?

  • Ideal alternative to a contentious seat for trainees whose primary interest is in non-contentious areas
  • Guaranteed to deliver both substantive and procedural experience
  • Perfect blend of practical face-to-face tuition and real-life experience through a Legal Advice Centre placement
  • Designed and delivered by experienced practitioners
  • Access to online i-Tutorials allows trainees to revisit key LPC litigation topics before starting the programme

How?

The programme consists of five days of face-to-face tuition and one week of practical experience in one of our Legal Advice Centres. In addition, trainees use i-Tutorials to revise the key litigation topics covered on the LPC, and complete a Litigation Learning Portfolio.

The face-to-face tuition is delivered by our highly experienced trainers at a time and location to suit you – either at one of our centres, your premises or an appropriate third party venue nationwide. Training is highly interactive and uses realistic exercises and scenarios to accurately mirror practice, taking trainees far beyond the level of the LPC. To maximise learning, delegates are asked to produce one piece of significant drafting per day (except for day five), receiving feedback the following day.

The following topics are covered:

  • Day one – the commencement of a case, including the first interview with a client, a legal and factual analysis of the action, advice to the client and case management. There is a refresher in relation to the civil procedure rules, client care and ethics
  • Day two – the progress of a case through the drafting and consideration of statements of case. The allocation of the case to the appropriate court and track is also addressed
  • Day three – the conduct of key procedural stages, to include disclosure, witness statements and expert reports
  • Day four – the common interim applications and the conduct of such applications, including a consideration of costs
  • Day five – ADR, with particular regard to negotiation and mediation

Trainees gain practical litigation experience by taking part in a one week placement at our new and well-equipped London Bloomsbury Legal Advice Centre. Trainees are supervised by qualified solicitors and work mainly on cases relating to landlord and tenant matters, leasehold disputes, and immigration bail.

Cases before the Tribunal Representation Property Service involve representing tenants before the tribunal including case preparation. Immigration cases involve the trainees in taking initial instructions at the immigration removal centre, they consider the merits of any application for bail and work on obtaining sureties, preparing cases and for any advocacy before an immigration judge.

Throughout the programme, trainees will be asked to keep a record of their training and learning points in a Litigation Learning Portfolio. This will include the drafting exercises carried out on days one to four.
