Personal Injury: Calculating Pension Losses

A personal injury which results in the claimant losing earnings power or prevents them from working at all may necessitate a claim for pension loss. However, with a huge range of variables in every case, calculating this loss is inevitably, complex. In addition, the most commonly relied upon method of calculation, the Ogden Tables, were updated in October 2011, so as to take into account a greater range of circumstances and updated mortality data, all of which will directly affect pension loss calculations.

This programme considers:

  • The rate of return used in pension loss calculations and the potential impact of the recent Guernsey case, Helmot v Simon (2010)
  • How to use these Tables to calculate pension losses including reference to specific examples
  • Other variables that may affect these calculations in specific cases

Practice Management & Compliance: Money Laundering Update

Recent case law has provided invaluable guidance on how to determine whether a money laundering offence under POCA 2002 has been committed. The Law Society has also issued a Practice Note on the Money Laundering Reporting Officer (MLRO) and it is now possible for the same person to be the Compliance Officer for Legal Practice (COLP).

This programme looks at:

  • Recent case law including Fitzpatrick v The Commissioner of Police of the Metropolis (2012) and Shah v HSBC (2011) (ongoing)
  • Practical guidance on the role of the MLRO plus internal controls and compliance procedures for firms

Contributors include Stephen Gentle (Partner, Kingsley Napley LLP) and Alison Matthews (Chair, Law Society’s Money Laundering Taskforce).
